GENERAL TERMS AND CONDITIONS OF CONTRACT


1.- CONDITIONS OF SERVICE: GENERAL INFORMATION
These Terms and Conditions govern your access to and use of the website, the services offered and their contracting by customers, as well as all collective content, and also constitute binding conditions. Please read these Terms and Conditions carefully each time you access the Website, as they may be modified.
We inform you that the trade name Smiley Viviendas Valencia is used by the Ambigramme SL Society, registered in the Mercantile Registry of Valencia, who offers the services proposed on the website and will be the owner of the lease contracts.
1.1. CONTRACTING PROCESS
This document will be public so that the client has easy access to the information. It will be considered that the contracting procedure begins at the same time that the client contacts the company Ambigramme SL through our contact email, applying the privacy policy from that precise moment. The Ambigramme SL company considers both landlords (owners) and tenants (individual clients) as clients and, therefore, said treatment will be applied to both at different times in their relationship with Ambigramme SL. The company Ambigramme SL makes available to its clients a database of accommodation with information and a photographic report aimed at helping the tenant-client to find the most suitable accommodation. All the information offered (descriptions, photos, characteristics, services and availability) belong to the company Ambigramme SL, and is made available to customers only for their evaluation. This information can be shared by the client to other people under the same conditions and only through the sharing of links to our pages.
The Ambigramme SL company proposes to its customers to choose between 3 entry packs: Basic, Comfort or Premium.
The Basic pack includes the following services and expenses: rental contract, verification of the condition of the home, configuration of biometric access and activation of supply contracts (water, electricity, internet, civil liability insurance).
The Comfort pack includes the benefits of the Basic pack and the delivery of an arrival basket (food + hygiene products) and a transport card are added.
The Premium pack includes the benefits of the Comfort pack and includes the delivery of a basket of bed linen and the possibility of requesting a driver upon arrival at the airport or train station and a 7-day cancellation insurance.
Added benefits are subject to availability (eg Food products)
The rental prices of the apartments on the website of the company Ambigramme SL may vary depending on the time of year or the conditions of the application and contracting, without the company Ambigramme SL being liable.
1.2. PROCESSING THE RESERVATION OF A PROPERTY
The processing of the reservation through this website implies the knowledge and express acceptance of these general contracting conditions by the client.
The client must choose the desired room, by sending an email to the following address: contact@smileyviviendasvalencia.fr
The Ambigramme SL company will contact the client and send him a questionnaire to fill out. The client-applicant must fill in the form and deliver to the company Ambigramme SL all the documentation required regarding their legal and financial situation, in order to evaluate the viability of the leasing operation.
Once the economic-financial study of the tenant or tenants who will live in the property has been completed, and if the operation has been authorized, the Ambigramme SL company will contact the client to carry out the rest of the contractual procedures.
The room will be considered reserved as soon as the client-applicant has paid the requested deposit, as well as the first month's rent.
1.3. BOND, GUARANTEE DEPOSIT AND INSURANCE
The client-applicant must pay two months as a legal guarantee (Art. 36 - LAU Urban Leasing Law), plus the guarantee deposit, at the time of signing the lease. These amounts will be returned at the end of the contracts, provided that there has been no breach by the tenant or damage due to misuse of the house by the tenant.
1.4. RIGHT OF WITHDRAWAL / CANCELLATIONS / CHANGES
If the client-applicant cancels more than 30 days in advance, the advance payment already paid will be returned.
If you cancel less than 30 days in advance, you will be penalized with 30% of the amount of the stay.
In case of canceling with less than 15 days in advance, it will be penalized with 50% of the amount of the stay.
Cancellations less than 7 days in advance will be penalized with 80% of the amount of the stay.
In case of no-show at the accommodation, 100% of the amount of the stay will be penalized.
Early departure from the accommodation will not be a reason for the refund of any of the amounts.
In case of non-payment, the deposit will be used to cover the corresponding amounts.
1.5. ENTRY AND DEPARTURE TIMETABLE IN THE APARTMENTS
The client is obliged to communicate his arrival and departure time to the apartment at least 3 days in advance.
At the time of the entry of the tenant (check in), a detailed and listed check will be made of the condition of the apartment, the furniture and its belongings through the inventory.
At the time of the tenant's departure (check out), there will also be a detailed check of the condition of the apartment, the furniture and its belongings.
In the event of damage or loss, the inventory (indicating the prices of each item made available) will be used to determine the amount that will be retained on the deposit.
The Ambigramme SL company will only check in and check out during business hours from 9am to 7pm. Any entry or exit from the apartments outside these hours will have an additional cost that will be communicated by mail.
1.6. USE OF THE APARTMENT AND STAYING PEOPLE
The apartment / room must be occupied by the person who signed the contract.
Companion animals will be prohibited only with the prior agreement of Ambigramme SL.
It will be forbidden to smoke inside the apartment as a whole.
All kinds of parties or meetings that could disturb the rest or tranquility of our clients and / or the neighbors of the properties are prohibited.
The client will immediately notify the Ambigramme SL company of any damage caused to the apartment or its contents by email.
The client will immediately notify the Ambigramme SL company of any fault found in the apartment by email.
The client is responsible for the visitors he invites and lets into the apartment.
The client will refrain from using the apartment for any purpose other than that agreed in the contract; subletting is prohibited.
The client will not carry out professional or commercial activities in the apartment or any type of activity prohibited in a civil or criminal way by law.
Our apartments are located in residential buildings. We demand that our guests behave appropriately. Don't make too much noise or make the music too loud. If the neighbors complain or if they have to call the police, you will have to vacate the apartment without the right to compensation or refund of the amounts paid for breach of contract. Remember that you are NOT allowed to carry out annoying or unhealthy activities, have parties or have pets without express authorization. The Ambigramme SL society takes care of your apartments, they are cleaned before your arrival and after your departure. However, if the apartment is too dirty, we reserve the right to deduct from the deposit the amount necessary to cover the cost of additional cleaning, as well as the damages caused by the tenant.
If there is any additional need and in the event that more people than those authorized by the Ambigramme SL company want to settle in, the client is obliged to inform the Ambigramme SL company of the increase in the number of people.
In this case, the Ambigramme SL company will propose an individual contract to the person who wishes to stay with the client already installed. The company Ambigramme SL by law must inform each adult who stays in our apartments, therefore the client must provide their name, surname, nationality, identification and date of birth to be incorporated into the registry and subsequently reported to the corresponding authorities.
2.- GENERAL CONDITIONS OF TEMPORARY LEASE AGREEMENTS
ON ONE PART.- THE COMMERCIAL LESSOR, whose data and representation are consigned in the lease.
AND ON THE OTHER.- THE LESSEE, not ordinarily resident in Valencia, and whose personal circumstances have been consigned in the lease, interested in renting the dwelling outlined in the aforementioned document for a season.
Both parties recognize sufficient legal capacity to contract and enter into a seasonal lease of the dwelling mentioned in the heading of this, according to the following,
CLAUSES
FIRST.- The seasonal lease contract on the aforementioned apartment is granted in accordance with the provisions of the current Urban Leasing Law. In everything that is not included in it, the provisions of the Civil Code will be applied additionally. The parties renouncing their own jurisdiction, submit to the Courts and Tribunals of Valencia.
SECOND.- The term for the seasonal lease that is the object of this present is the one set out in the lease. Upon the expiration set forth in said clauses, this contract will cease to be in force.
THIRD.- The fixed income for the reference period is reflected in the lease contract. This amount includes the costs of supplies (water, electricity, internet, entrance cleaning), not including the cleaning of kitchen utensils and crockery, since the tenant is obliged to deliver these clean and tidy, as how you receive them at the end of your stay.
In the same way, the tenant must deliver the accommodation in the same cleanliness and habitability conditions in which it was on arrival.
At the time of entry into the apartment, the tenant will authorize the Ambigramme SL company to take a copy of their fingerprints, which will serve as a key and will be the only way to enter the apartment. The tenant will give his consent in writing to the conservation of his prints, during the duration of the contract. As soon as the lease expires, the company Ambigramme SL undertakes to remove the traces from its database.
The entries and exits in the accommodation will be made during business hours from 9:00 a.m. to 7:00 p.m. The entries and exits outside these hours will carry a surcharge, indicated by email.
FOURTH.- All our prices for our additional services include the VAT in force (VAT exempt for housing contracts, 21% for the provision of services).
FIFTH.- The apartment is furnished, with the furniture, belongings and objects that are listed in the inventory that is inside the house. The tenant declares that he has examined the rented apartment as well as the furniture included in it, acknowledging that it is in perfect condition of use and occupation.
SIXTH.- Neither the Ambigramme SL company nor the apartment owners will be responsible for any damages that may occur during their stay in the apartment, including and without limitation, personal injury, death or loss, whether due to fire, theft or flooding or due to the action or personal irresponsibility of the client, the unauthorized access of a person to the apartment or due to the misuse of the elements included in the accommodation.
The tenant party will be liable for damages due to breach of contractual obligations and for damages originating in the apartment or in the furniture included in this lease. The tenant is responsible, not only for his own acts, but for those committed by the occupants of the rented apartment, both for the purposes of contractual resolution, and for possible compensation for damages. Therefore, a civil liability insurance is established for the client, included in the rental price. In addition, the lessee expressly empowers the lessor, so that, charged to the amount delivered as a guarantee deposit (reflected in the lease contract), retain and endorse the equivalent amount that compensates the damages or expenses that he has caused.
SEVENTH.- In the event that you have a confirmed reservation and the Ambigramme SL company cannot accommodate you in the apartment of your choice, the responsibility of the Ambigramme SL company will be limited to providing accommodation in an apartment with similar characteristics or the reimbursement of the amounts delivered as a reservation, in case of not being able to meet the client's request.
At Ambigramme SL we strive to accurately describe our apartments. If any dispute arises regarding the description of the apartment, the responsibility of the company Ambigramme SL will be limited to reimbursing the amounts paid, less the cost of the days spent, if it decides not to stay in the apartment.
EIGHTH.- The reserved apartment can only be used as temporary accommodation of the number of people reflected in the lease (s) and for the time previously paid by the client. In no case can it be used as a habitual residence or carried out in the same business activity by any of the occupants of the apartment. The client is prohibited from subletting and the partial or total assignment of the apartment, whether for free or onerous. No commercial or illegal activity can take place in the reserved apartment. It is also prohibited to hold parties and any immoral, annoying, unhealthy activity prohibited by law.
NINTH.- In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data and the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 from
April 2016, we inform you that the data provided through the client file will be incorporated into the file of AMBIGRAMME SL, with CIF B40523276 and address at Calle Garbi, 4, 46183, L'ELIANA (VALENCIA) in order to be able to provide the requested and / or contracted service, perform the billing thereof.
Likewise, the interested party authorizes the use of their personal data for commercial and advertising purposes, regarding any advertising action related to the company's services.
In the event of any modification of your data, please inform us duly in writing in order to keep your request updated.
The data provided will be kept as long as the commercial relationship is maintained or during the years necessary to comply with legal obligations. The data will not be transferred to third parties except in cases where there is a legal obligation. You have the right to exercise your rights of access, rectification, limitation of treatment, portability, opposition to the treatment and deletion of your data as well as the right to file a claim with the Control Authority by writing to the aforementioned postal or electronic address to contact@smileyviviendasvalencia.fr, attaching a copy of the DNI / NIE or identity card / valid passport in both cases.
Likewise, they are informed that the homes have a video camera system designed to guarantee the safety of their guests and people who attend their facilities. The above information is subject to the rights recognized by Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data. , as well as its development legislation.
TENTH.- For any conflict over our services, Spanish law will be applied from the Courts and Tribunals of Valencia.
